Terms of Service

1. ONLINE BOOKINGS AND PAYMENT

1.1 ONLINE BOOKINGS

Online bookings can be made via the Website or by contacting the Service Provider directly (via Instagram or Facebook messenger). Bookings made via the website will be confirmed within 12 hours. Contact will be made via email to confirm Your booking with a link to fill out the online Pre-Appointment Intake Questionnaire.

1.2 PAYMENT (STRIPE)

Payments will be processed via Stripe. All Initial Consultations require 100% fee payment to confirm appointment booking (a 50% fee applies for cancellations within 24 hours. See Section 7.1). Following your online enquiry, you will receive a Pre-Appointment Intake Questionnaire and invoice via email which must be paid prior to the Initial Consultation.

1.3 PACKAGES

Nourished Performance offers different nutrition coaching service packages (‘The Wellness Package,’ ‘The Nourished Athlete Package.’). The initial consultation fee is payable at the time of the initial consultation (fee as listed on the Website). Packages pricing is inclusive of a 12-week service period payable as a lump sum (fee as listed on the Website) or Direct Debit via Stripe at a fee of $25.00 AUD per week. For Individuals participating in these packages, payment information will be collected at the conclusion of your initial consultation.

Package pricing is current as at 01/07/2024 and is subject to yearly review. 


2.1 SUBSCRIPTIONS AND PAYMENT PROCESSING (STRIPE)

Packages pricing is inclusive of a 12-week service period payable as a lump sum (fee as listed on the Website) or Direct Debit via Stripe at a fee of $25.00 AUD per week. For Individuals participating in these packages, payment information will be collected at the conclusion of your initial consultation.

Ongoing nutrition coaching is available following the expiry of the 12-week service period via Direct Debit at a fee of $25.00 AUD per week.


3.1 INITIAL CONSULTATION AND METABOLIC HEALTH PRE-SCREENING

3.1.1 PRE-APPOINTMENT INTAKE QUESTIONNAIRE

Prior to the initial consultation, the online Pre-Appointment Intake Questionnaire must be completed by the Individual. The Pre-Appointment Intake Questionnaire will collect Personal Data pertaining to Your health and performance goals, basic health information, and lifestyle information. 

3.1.2 HEALTH PRACTITIONER REFERRAL

Should it present from your Pre-Appointment Intake Questionnaire, it may be necessary to refer You for further guidance from an appropriately qualified healthcare professional (such as General Practitioner, Accredited Practicing Dietitian, Physiotherapist, or Psychologist). Referral for further management will be given with Your informed consent. Further healthcare management will come at the Individual’s expense and is the Individual's sole responsibility to complete. 

The Individual may continue to work with the business under collaborative guidance of the healthcare professional given Services remain within the Service Provider’s Scope of Practice (see Section 5.1).


4. PACKAGE INCLUSIONS

Packages are inclusive of, but not limited to:

4.1.1 THE WELLNESS PACKAGE

  • 60min Initial consultation (online; delivered via Zoom)
  • Nutrition strategies document (PDF, delivered via email): may include meal plan and/or macronutrient strategies, nutrient timing and exercise nutrition, general health supplement advice, habit tracking, food tracking guidance.
  • Weekly online check-in (online; delivered via Google Forms)
  • Food diary video feedback (online; delivered via Loom video or video; if applicable)
  • 20min Online check-in (online; delivered via zoom); up to 6 per 12-week coaching period
  • Updated nutrition strategies document (PDF; delivered via email, if applicable)
  • Business hours contact via email, Instragram or Facebook Messenger.

4.1.2 THE NOURISHED ATHLETE PACKAGE

  • 60min Initial consultation (online; delivered via Zoom, or in person)
  • Nutrition strategies document (PDF, delivered via email): may include meal plan and/or macronutrient strategies, nutrient timing and exercise nutrition, general health supplement advice, habit tracking, food tracking guidance, specific sports nutrition strategies (including but not limited to training nutrition, competition/race day plans, gut-training strategies, sports supplement advice).
  • Weekly online check-in (online; delivered via Google Forms)
  • Food diary video feedback (online; delivered via Loom video or email)
  • 20min Online check-in (online; delivered via zoom); up to 6 per 12-week coaching period
  • Updated nutrition strategies document (PDF; delivered via email, if applicable)
  • Business hours contact via email, Instragram or Facebook Messenger.

4.1.3 ONE-OFF CONSULTATION AND ONE-OFF REVIEW CONSULTATION

  • 60min Initial consultation (online; delivered via Zoom).
  • Nutrition strategies document (PDF, delivered via email): may include meal plan and/or macronutrient strategies, nutrient timing and exercise nutrition, general health supplement advice, habit tracking, food tracking guidance.
  • No online check-ins, feedback or follow-up.
  • One-off review consultations (30min) available for existing one-off consult clients within 3 months of initial consult. 

4.1.4 CORPORATE HEALTH EVENTS AND SPORTS NUTRITION EDUCATION

Corporate health event and sports nutrition education inclusions vary based on the type of event, it’s participants and the length of the event. For extended events, such as workshops, payment must be made in full at least 7-days prior to the commencement of the event. 

4.2 SERVICE DELIVERY TIMEFRAMES

  • Following the Initial Consultation, Nutrition strategies document (PDF; delivered via email) will be delivered within 7 business days of the Initial Consultation.
  • Following completion of weekly check-ins, feedback will be provided within 3 business days of the completed check-in.
  • Following online check-ins, updated Nutrition Strategy Document will be delivered within 3 business days. 

4.3 CONCLUSION OF SERVICE PERIOD

Packages are inclusive of a 12-week Service Period. At the conclusion of the service period, the Individual will receive a Graduation questionnaire (via Google Forms). This questionnaire will collect Personal Information pertaining to the individual’s health and performance outcomes and collect feedback regarding the Service for Business internal analysis.

At the conclusion of the Service Period, Individuals may opt in for ongoing Nutrition Coaching or review consultations.


5.1 SCOPE OF PRACTICE

Services provided align with scope of practice documents as provided by Sports Nutrition Association for openly accredited practicing members. The service provider has an obligation to remain professional accreditation through the governing body and maintain professional insurance for the duration of practice. 

As outlined in the Sports Nutrition Association Scope of Practice (2024) document:

“The key competencies and practice scope for a Sports Nutrition Association Open Qualification Practitioner include:

  • Engaging directly with moderate risk clientele.
  • Engaging directly with high level amateur and professional athletes.
  • Except in circumstances where further specialised education has been undertaking, refraining from working with any class of athlete that is subject to ‘anti-doping’ testing.”

And adhering to areas listed as “Prohibited Areas of Practice for Accredited Sports Nutrition Association Sports Nutritionists” including management of eating disorders, gut health, blood tests and result interpretation, body image, and treatment and management of any disease or medical contraindication” unless under the supervision and collaboration with an appropriately qualified health professional (eg. General practitioner, Accredited Practicing Dietitian, psychologist).


6. CANCELLATION POLICY

6.1 INITIAL CONSULTATION

Initial Consultations fees must be paid in full prior to the Initial Consultation. Initial Consultations are subject to 50% cancellation fee within 24 hours. Where the appointment has been paid in full, a partial (50%) refund will be paid. 

6.2 ONGOING NUTRITION COACHING SUBSCRIPTION

Packages (‘The Wellness Package,’ ‘The Nourished Athlete Package.’) are subject to a minimum Service Period of 12-weeks (fee paid via Direct Debit or lump sum at the time of Initial Consultation). An early cancellation fee applies of 50% of the remaining package cost (minimum 2 weeks).

For ongoing nutrition coaching subscriptions (past the conclusion of the minimum 12-week Service Period), a 2-week cancellation period applies under which time normal Services will apply.

6.3 CORPORATE HEALTH AND SPORTS NUTRITION EDUCATION

Corporate health and sports nutrition education events are subject to a 72-hour cancellation period. For extended programs (such as corporate health or sports nutrition workshops) a cancellation fee of 50% applies.

6.4 CANCELLATION BY THE BUSINESS

In the event of cancelling by the Business or Service Provider, the Individual will be entitled to: 1) appointment rescheduled within 14 days of the original booking; or 2) a credit of all amounts paid to be used towards future Services (expiry of 12 months); or 3) a full refund of any amounts paid.

6.5 EXTENUATING CIRCUMSTANCES

Cancellations due to extenuating circumstances are urged to contact the Service Provider via email and will be dealt with at the Service Provider's discretion.


7. REFUND POLICY

7.1 LATE CANCELLATION OF SERVICES

Initial Consultations fees must be paid in full prior to the Initial Consultation. Where the appointment has been paid in full, a partial (50%) refund will be paid. No refunds will be given where services have been provided (ie. Initial Consult has been conducted and/or Nutrition Strategies given).

For corporate health and sports nutrition events, a 50% cancellation fee applies where cancellation occurs within 72 hours of the event. No refund will be given for cancellation within 72 hours of event commencement. 

7. EARLY CANCELLATION OF SERVICES

Where the Individual has paid a lump sum and requested Early Cancellation of Services (as outlined in Section 6.2), the Individual is entitled to a refund of 50% the remaining services given they are outside the specified cancellation period (minimum 2 weeks).
